Austin Approves New Building Codes to Increase Housing Options

On April 10, 2025, the Austin City Council approved significant amendments to the city’s building codes aimed at addressing housing shortages and enhancing living conditions. These updates are poised to take effect on July 10, 2025.

What Happened

The city council sanctioned a change allowing the construction of apartments up to five stories high with a single staircase. This modification is part of the broader technical building codes that were introduced in 2024. The newly designed structures will feature advanced safety measures, including sophisticated fire suppression systems and protected stairwells, making them a safer option despite only having one means of egress.

Who Is Affected

The primary beneficiaries of this code change are the residents of Austin and prospective renters, as the new regulations aim to increase the availability of affordable housing. Each single-exit apartment building is permitted to have no more than four apartments per floor, ensuring adequate access to exits during emergencies. This design is expected to promote livability in the city.

Official Response

City officials, including Councilmember José “Chito” Vela, advocated for this measure, arguing that it aligns with Austin’s vision of a more affordable and walkable urban environment. However, the decision has sparked discussions concerning public safety. Austin Fire Chief Joel Baker expressed concerns regarding the fire department’s resources to manage responses in these types of buildings, along with the time it takes to acquire new firefighting trucks.

In contrast, Vela reassured citizens that safety protocols would be applied rigorously, similar to those in cities like Seattle, where single-staircase buildings are already established.

Safety Concerns

While the initiative aims to make housing more accessible, it has raised questions regarding fire safety. In response to these concerns, the new codes stipulate that the staircases will be centrally located, allowing for windows on both sides of the building. Additionally, the design is expected to feature air conditioning systems that ensure indoor temperatures remain below 85 degrees, which is particularly beneficial in light of rising temperatures due to climate change.

Impact on Infrastructure and Environment

One of the noteworthy aspects of the updated regulations is the expanded Wildland-Urban Interface (WUI) and Proximity Zone C, increasing areas identified as at risk of wildfire from 38% to 51%. New constructions in these zones will need to implement defensible space and utilize fire-resistant materials, thereby improving community safety.

Moreover, eco-friendly building materials, such as hempcrete, have been sanctioned for residential use as part of the city’s sustainability efforts. The updated codes will also mandate electric vehicle (EV) charging infrastructure in new residential and commercial properties, further promoting sustainable transportation options.

Enhancements in Building Maintenance and Safety

The city is introducing heightened pest control standards focusing on common issues like bedbugs and scorpions in multi-unit buildings. Furthermore, high-rise buildings will be required to have improved emergency lighting to ensure safety during power outages and emergencies.

Austin is also working on ensuring that air conditioning installations are accessible to all residents, following a resolution passed in 2023 aimed at improving air conditioning access during extreme heat events.

What’s Next

The new building codes reflect Austin’s ongoing effort to address housing challenges, improve safety, and enhance sustainability in urban development. As the effective date approaches, the city plans to implement educational initiatives to inform residents and builders about the changes, ensuring adherence to the new regulations and promoting community safety.

Through these measures, Austin is taking significant steps toward creating a more livable environment, balancing growth and safety in the face of expanding urban development.
