Austin Businesswoman Sues Over Defamation Allegations

In Austin, a prominent entrepreneur is taking a stand against claims that she and her businesses are involved in illegal activities. Gabriela Bucio, who owns multiple successful clubs and bars, has filed a defamation lawsuit against the Pecan Street Owners Association (PSOA). The lawsuit follows a report released by the PSOA that accused Bucio’s businesses of being involved in drug-related issues and violence.

Details of the Lawsuit

Bucio is seeking $250,000 in damages from the PSOA, its president, and a private investigator named Marcus Stokke. The lawsuit argues that the claims made against her are untrue and have harmed her reputation and her businesses. In a statement, Bucio expressed her determination to pursue the matter vigorously, saying, “I intend to pursue this matter vigorously to ensure that justice is served and that my good name is unequivocally restored.” She went on to emphasize the importance of this case not just for herself, but for her family, community, and others facing discrimination.

Background on the Investigation

Last year, the PSOA hired Stokke, a former supervisor with the Texas Alcoholic Beverage Commission, to investigate various bars on Austin’s Sixth Street. For two weeks in March, Stokke conducted undercover operations, visiting several bars, including Bucio’s Mala Vida and Space Siete. In his report, Stokke alleged he witnessed drug use and sales occurring inside and around the establishments.

According to Stokke’s findings, some bars were reportedly staying open past mandatory closing times and continuing to serve alcohol without the necessary permits. He described the situation as part of a “total criminal enterprise” and noted that he found evidence of drugs present within the venues. His report also indicated he observed the management of these establishments engaging in inappropriate behaviors that could lead to their licenses being revoked.

Response from Stokke and PSOA

In his defense, Stokke claimed that his investigation was not racially motivated and pointed out that he is a minority himself as a Canadian citizen. He emphasized his commitment to accurately reporting the facts and expressed admiration for Bucio’s entrepreneurial success. Stokke has even offered to help Bucio resolve any issues they may face in the future.

Bucio’s lawsuit argues that before this investigation, her businesses had a stellar reputation and that the recent allegations have put them under a “heightened level of scrutiny” from law enforcement and regulatory agencies. The suit characterizes Stokke’s statements as false and damaging, asserting that they portray her as a criminal and her establishments as “criminal enterprises.”
