The teacher, Luis Erasmo Resendiz Alvarado, who worked at Reilly Elementary School as a first-grade teacher, has been terminated from his position following the incident.

According to court documents, the troubling event occurred on September 10 when Alvarado allegedly used a classroom door to pin the young student against a wall. This violent act has led to a felony charge of unlawful restraint, which can become a more serious issue when involving a child.

Legal expert and criminal defense attorney Sam Bassett, not involved in this specific case, explained, “Unlawful restraint is usually a misdemeanor but in certain circumstances, it could be a felony if it involves a child under a certain age.” Bassett stressed that the legal implications are much more serious due to the child’s age.

After the incident, the six-year-old shared the experience with their parent when they returned home from school. The parent took immediate action by contacting the assistant principal and filing a report with the Austin Independent School District (AISD) police. The district acted swiftly, placing Alvarado on administrative leave as soon as the allegations came to light.

Further investigation revealed that Alvarado reportedly admitted to his actions, stating, “I kept, I kept him trapped.” Surveillance footage from a hallway camera supported these claims, which likely contributed to the strong case against him.

Alvarado was arrested on October 1, 2023, and was subsequently released on a $7,500 bond the same day. Legal expert Sam Bassett discussed what could happen next for Alvarado, indicating that he might face up to two years in the state jail system. However, he noted, “Typically, if somebody has this type of charge, and they don’t have a criminal record, it is unlikely they would be sentenced to incarceration, probably a probation sentence most likely.” This indicates that the outcomes can vary depending on Alvarado’s past legal history.
